NBC TERMS OF USE (nbc Plus Services)

1. NBC TERMS OF USE

1.1. NBC provides a subscription service that allows our viewers to watch NBC Linear Channels and Live Content streamed over the Internet to mobile devices and Tablets, Lap tops, Desktops, nbc Plus Set Top Box and other smart devices ("Android ready devices").

1.2. The nbc plus service is provided to you by the Namibian Broadcasting Corporation, and its technical partners On Demand Television Namibia. These Terms of Use govern your use of our service. As used in these Terms of Use, "nbc Plus Service", "our service" or "the service" means the service provided by nbc plus for watching NBC TV channels and listening to NBC radio services, including all features and functionalities, recommendations and reviews, the website, and user interfaces, as well as all content and software associated with our service.

1.3. nbc Plus provides four different packages to subscribers, which are as follows; 7 days, 1 month, 6 months and 12 months packages. To use the nbc Plus Service you must download the nbc Plus application on either IOS or Android device and you can stream via your browser on nbcplus.na, register on the NBC website, select a package and accept method of payment, which you may update from time to time ("Payment Method"). All payments will be deducted immediately before the use of services.

1.4. You can find specific details regarding your nbc Plus subscription information by visiting our website and clicking on the "frequently asked questions" link available at the NBC website. Continued use of these services shall constitute acceptance of these Terms and Conditions of Use, as may be amended from time to time.

2. SUBSCRIPTION FEES

2.1. Subscriptions and any other charges you may incur in connection with the use of this service, such as taxes and possible transaction fees are automatically charged each billing period (whether weekly, monthly, annually, or another period), and you may be charged no more than 24 hours before the beginning of each billing period. See the packages on the NBC website by clicking on the “frequently asked questions”.

2.2. In some cases your payment date may change, for example; if your Payment Method has not successfully been settled or if your subscription began on a day not contained in a given month. The payment on all the packages will be concurrent unless stopped by the subscriber. Visit our website and click on the "Billing details" link on the "Your Account" page to see your next payment date.

3. PAYMENT METHODS

You can change your Payment Method by visiting our website and clicking on the "Your Account" link. When you update your Payment Method, you authorize us to continue charging the updated Payment Method and you remain responsible for any uncollected amounts. This may result in a change to your payment dates. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.

4. CANCELLATION

4.1. You may cancel your nbc Plus subscription fee at any time, and you will continue to have access to the nbc Plus Service for the selected package period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial subscription or unwatched NBC channels.

4.2. To cancel, go to the "Your Account" page and follow the instructions for cancellation. If you cancel your subscription, your account will automatically close at the end of your package period, this is only applicable for 6 months and 12 months package. If you subscribe via a third party as a payment method, e.g. eWallet and wish to cancel your subscription, you may need to do so through such third party. You may also find billing information about your nbc Plus subscription by visiting your account under your account details.

5. PRICE ADJUSTMENTS

When you purchase a subscription, you will initially be charged at the rate applicable at the time of your agreement to subscribe. NBC may adjust the packages and the prices of the service from time to time. Any price or package adjustment will apply to all the subscribers no earlier than 30 days following a notice on the NBC platforms (radio, TV, Social Media and nbc Plus).

6. NBC PLUS SERVICES

6.1. nbc Plus services will have a variety of Television and Radio Channels cutting across all ages (+3 years to 60+ years). Anyone is eligible to subscribe to the service. Minors should be assisted and supervised by an adult when using the application. The NBC will not be held liable for any unsupervised minor’s conduct.

6.2. nbc Plus channels/content will be available in all geographical locations. The numbers of channel will vary and might be adjusted from time to time. The number of devices on which you may simultaneously watch might be more in future depending on the package you are subscribed to.

6.3. nbc Plus services can be viewed on the following devices; smart devices (Mobile Phones & Tablets), Laptop, Desktop, nbc Plus Set Top Box and Smart TVs.

6.4. NBC may at its own discretion, without the subscriber having any claim in respect of such changes; regularly make changes to the service, including the addition of channels, and content on its SVOD library. In addition, NBC will continually test various aspects of the service, including the website, user interfaces, promotional features and availability of nbc Plus content.

6.5. You agree to use the nbc Plus service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein.

6.6. You also agree not toby-pass, remove, alter, deactivate, degrade or thwart any of the content protections in the nbc Plus service; use any robot, spider, scraper or other automated means to access the nbc Plus service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the nbc Plus Service; insert any code or product or manipulate the content of the nbc Plus Service in any way; or use any data mining, data gathering or extraction method.

6.7. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the nbc Plus Service, including any software viruses or any other computer code, files or programs.

6.8. The NBC may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.

6.9. The quality of the display of the nbc Plus content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. The content is available on standard definition (SD) and the availability is subject to your Internet service and device capabilities. Not all content is available in all formats, such as SD, HD, Ultra HD or HDR. The minimum connection speed for SD quality is 0.5 Mbps; however, we recommend a faster connection for improved video quality.

6.10. A download speed of at least 5.0 Mbps per stream is recommended to receive HD content (defined as a resolution of 720p or higher). You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges. The time it takes to begin watching nbc Plus content will vary based on the available bandwidth at the time.

6.11. The nbc Plus software is developed by, or for the NBC and is designed to enable viewing of nbc Plus content through NBC ready devices that includes Mobile phones, Laptops, Desktops, Smart Devices and nbc Plus Set Top Box. You agree that you may automatically receive updated versions of the nbc Plus on all the access platforms and any other third-party software.

7. INTELLECTUAL PROPERTY RIGHTS

7.1. All editorial content, information, photographs, illustrations, artwork and other graphic materials, and names, logos and trade marks on the nbc Plus Services are protected by copyright laws and/or other laws and/or international treaties, and belong to us and/or our suppliers, as the case may be. These works, logos, graphics, sounds or images may not be copied, reproduced, retransmitted, distributed, disseminated, sold, published, broadcasted or circulated whether in whole or in part, unless expressly permitted by us and/or our suppliers, as the case may be.

7.2. Nothing contained on the nbc Plus Services should be construed as granting by implication, estoppel, or otherwise, any license or right to use any trademark displayed on the service without our written permission. Misuse of any trademarks or any other content displayed on the service is prohibited.

7.3. NBC will not hesitate to take legal action against any unauthorised usage of our trade marks, name or symbols to preserve and protect its rights in the matter. All rights not expressly granted herein are reserved. Other product and company names mentioned herein may also be the trademarks of their respective owners.

7.4. nbc Plus service remains the intellectual property of creator/producer, in this case, NBC.

8. PASSWORDS AND ACCOUNT ACCESS

8.1. All the nbc Plus subscribers will be entitled to create an account and all the successful accounts shall be charged based on different Payment Method. The subscriber will have access and full control to nbc Plus on their smart devices, laptop, Desktops, smart TVs and nbc Plus Set Top Box.

8.2. To maintain control over the account and to prevent anyone from accessing the account (which would include information on viewing history for the account), the Account Owner should maintain control over the nbc Plus ready devices that are used to access the service and not reveal the password nor details of the Payment Method associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold in order to protect you, the NBC or our partners On Demand TV Namibia from identity theft or other fraudulent activity.

9. GOVERNING LAW
The Terms of Use shall be governed by and construed in accordance with the laws of the Namibia.

10. CUSTOMER SUPPORT

If you need assistance with your account please visit the NBC Help desk on our website (www.nbc.com) to find more information about our service and its features, or call us on 061 291 3142. In the event of any conflict between these Terms of Use and information provided by Customer Support or other portions of our website, these Terms of Use will take control.
11. CHANGES TO TERMS OF USE AND ASSIGNMENT

NBC may, from time to time, change these Terms of Use. We will notify you at least 30 days before these new Terms of Use apply to you. We may assign or transfer our agreement with you including our associated rights and obligations at any time and you agree to cooperate with us in connection with such an assignment or transfer.

12. COMMUNICATION

NBC will communicate to you information relating to your account (e.g. payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.

13. WARRANTIES AND LIMITATIONS ON LIABILITY
The nbc Plus Service is provided "as is" and without warranty or condition. In particular, our service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. These terms will not limit any non-waivable warranties or consumer protection rights that you may be entitled to under the laws of your country of residence.

14. CLASS ACTION WAIVER

14.1. Where permitted under the applicable law, you and the NBC agree that each may bring claims against the other only in your own or individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

14.2. Further, where permitted under the applicable law, unless otherwise agreed upon by both parties, the court may not consolidate more than one person's claims with your claims, and mayot otherwise preside over any form of a representative or class proceeding.
